TERMS & CONDITIONS

We understand that plans can change, so our rescheduling/cancellation policy is designed to be fair on you and us!  The policy allows you to make adjustments to your booking up until a couple of weeks before your tour.

You acknowledge by making a booking that you agree to our full Terms and Conditions.

BOOKING FEES

To hold your preferred tour date and to ensure we can provide the best service and vehicle possible for your tour, a booking fee is payable at the time of booking.  The booking fee will be at least the equivalent of any fixed booking costs for tastings or experiences, or 50% of the total tour cost, whichever is the greater amount.

PAYMENT

We will hold a tour date for up to 2 days after a deposit invoice is due.  Your final invoice is due three business days prior to your tour.  If your final invoice payment has not reached our account prior to your tour commencement, all deposit fees paid will be forfeited and your tour will be cancelled.

CANCELLATION

The following conditions apply if you wish to cancel your booking under our exclusive private range:

  • Cancelling 30+ days before your tour – we will offer a refund minus your booking fee.
  • Cancelling 14 – 29 days before your tour – we will offer a credit for the cost of your tour minus your booking fee. There will be an expiry date set on the credit of 24 months.
  • Cancelling 0 – 13 days before your tour – non-refundable/non-creditable.

All private group tours are completely non-refundable.

PERSONAL BELONGINGS

It is your responsibility to take care of your personal belongings at all times. We are not responsible or liable for any personal belongings left unattended.

TRAVEL INSURANCE

We encourage our customers to purchase travel insurance to cover any unforeseen circumstances.

Divine Tours Pty Ltd (operator) reserves the right to vary or cancel tours owing to weather extremes or changes to operational conditions (eg road closures, fire bans or other circumstances) beyond the control of the operator.

RESCHEDULING

Any bookings rescheduled with a minimum of 7 days’ notice, will forfeit the deposit however all other costs will be transferred to the new date. Any tours rescheduled within 7 days of the booking will be non-refundable and non-creditable. If you are unsure of a new tour date, we are more than happy to hold your tour cost in a credit for you to re-book at a later date (minus your booking fee).

If accommodation needs to be rescheduled, you will be responsible for any variation in pricing for the new dates (including changes made due to unforeseen eg Covid-19)

COVID-19

If your booking is impacted by a government enforced lock down/restrictions or natural disaster, you will receive a credit only to the value of your tour or package. There is an expiry on your credit of 24 months. Please note, we do not split the credit and all monies paid are viewed as a single transaction. We DO NOT offer refunds.

DO YOU NEED TO MAKE CHANGES TO YOUR BOOKING?

If you wish to make changes to your group size, please let us know at least 2 weeks prior to the tour where possible. People no longer going on the tour will fall into our cancellation policy stated above. Please note our tours are not based on a per person price, so please get in touch with the team to determine eligibility in terms of a credit/refund. Any changes to your booking 0-13 days before your tour will incur an admin fee.

We are happy to take venue requests/places you don’t wish to visit up until 7 days after your deposit is paid and we will do what we can to make them happen. We attempt to book any and all requests but please understand that many venues have capacity limits and restricted availability. If we are unable to get you into one of your preferred wineries, we will substitute it for a similar venue. If you receive your itinerary the week of your tour and wish to make any last minute amendments to the day, we will charge an admin fee (per change) to do so.

ITINERARY

You will receive your full itinerary the week of your tour. This allows for us to confirm booking times/group sizes with the venue the week leading up to your day. Your final itinerary will be provided when final payment has been made.

All itineraries and quotations provided are based on a single point pick up and drop off location.  If you require multiple pick up and drop off locations, this is chargeable.  

We will create itineraries deemed suitable according to tour requests and timing for the number of people on tour.  Should we not make a particular stop on time during a tour, tasting fees charged in advance will not be refundable.

VEHICLE DAMAGE

The person who makes the booking will be viewed as the main contact for the group and will be responsible for any damages to the vehicles or property caused by any member of the party. Damage includes vomiting on the bus.  This attracts a $500 cleaning fee.

SPECIAL REQUIREMENTS

We will do our best to ask questions to prepare fully for your tour, but it is the sole obligation of the customer to communicate to diVine Tours if you have any special requirements on the day of the tour eg mobility issues, dietary requirements, baby or toddler seats.  Please note – if we are aware of the need in advance that a baby restraint seat is required, we will provide you with a vehicle that has an ISOFIX compatible fitting.  It is the sole obligation of the customer to bring any necessary extension belts as required and the customer MUST fit the child car seat themselves.  Our drivers are not responsible for fitting child seats.

GENERAL & ON THE DAY OF THE TOUR

The customer acknowledges that the sole obligation of the operator is to convey a customer safely to and from agreed points of departure & arrival & that the operator shall have no liability whatsoever to the customer whilst outside the operator’s tourist vehicle. Whilst all care is taken, the operator accepts no responsibility for loss or damage to personal belongings or delays.

The driver may at any time refuse to carry any person who in the driver’s opinion exhibits unacceptable behaviour, is aggressive, threatening, or apparently affected by alcohol or other drug, or causes fear to any reasonable person at any location at which the operator attends.

At times it may be necessary to provide alternative transport or use the services of another accredited tour operator.

Seatbelts are fitted and must be worn at all times.

*terms and conditions are applicable to all bookings made from 1 July 2022. If you booked prior to this date, please see the t&c’s stated on the invoice you paid.

Any special offers or discounts relate to the calendar year within which they are advertised and are only available to clients who have paid for a full tour the year prior.
